This study was a preliminary exploration of the value changes taking place in the United States since the September 11, 2001 terrorist attack on the World Trade Center in New York, which was a significant emotional event or cultural upheaval. Rokeach told us that "a person's total value system may undergo change as a result of socialization, therapy, or cultural upheaval..." (Rokeach, The Nature of Human Values, 1973, p. 37). The researchers explored the value changes of 500 aviation industry employees (...) before the attack and 500 after the attack. The statistically significant research results showed a total of twenty-seven of thirty-six values changed. Before the attack respondents valued much higher self-esteem and self-actualization values like A Sense of Accomplishment and Self-Respect. After the attack respondents placed a much higher value importance on survival, safety and security values like A World at Peace, Freedom, Family Security, National Security, Mature Love, Salvation, and True Friendship. Scientists, both modern and contemporary, commonly try to discern patterns in nature. They also frequently use arguments by analogy to construct an understanding of the natural mechanisms responsible for producing such patterns. For Robert Boyle, the famous clock at Strasbourg provided a perfect paradigm for understanding the connection between these two scientific activities. Unfortunately, it also posed a serious threat to his realistic pretensions. All sorts of internal mechanisms could produce precisely the same movements across the face of a clock. (...) Given God's immense creative capacities, Boyle realized that standard epistemological constraints could never ensure, not even to the least degree of probability, that scientific theories about the unobservable mechanisms of nature were descriptively accurate. Like most moderns, he fortified his epistemology theologically in order to retain his realistic stance. John Locke, however, took counsel from Ecclesiastes to repudiate Boyle's realism, while Samuel Clarke mobilized biblical images to dismiss the clockwork paradigm altogether.A contemporary review of this modern controversy reveals that there is still much to learn from the clock at Strasbourg. Among other things, the realism/antirealism issue is of central importance to understanding today's science, Nancey Murphy's protests notwithstanding. Moreover, the kind of realistic stance that is essential, not only to the truth but to the very intelligibility of certain types of scientific explanation, demands more than the critical realism of Ian Barbour. English and Australian judges have, over the past few decades, severely questioned the juridical distinctiveness and utility of the rule in Rylands v Fletcher. The popular assertion in this country has been that the rule is really only a sub-species of the law of private nuisance. By contrast, the Australian judiciary has abandoned the rule altogether, preferring to expand the law of negligence to capture the rule's former territory. This article seeks to defend the rule in Rylands v Fletcher. In (...) particular it asserts that, by reference to their historical origins, the rule in Rylands v Fletcher and the law of private nuisance can be seen to be quite different creatures. It also argues that there is strong case for the rule's continued vitality, and that it would be a grave mistake to abandon it in favour of a yet more expansive law of negligence. (shrink)

Asylum seekers, by their very circumstances, test our common assumptions and practice in relation to human rights. The treatment of asylum seekers in many European countries has become harsher, more restrictive and less tolerant in recent years, raising questions about the violation of their rights. The article examines the bases of the rights that asylum seekers do have and whether these are best supported as human rights or more limited rights that attach to the place of their temporary residence and (...) to obligations made by their country of temporary residence. Given the propensity of receiving countries to afford increasingly limited rights, the article identifies a limited set of rights that should take priority in a hierarchy of rights and which might claim widespread acceptance as those which asylum seekers must enjoy. President Lincoln's platform included a recommendation of "a vigorous and just system of taxation," because he believed that if you had been blessed by living in America and had benefited from what this country has to offer, then you should do more for your country. One hundred forty years later, we still need a "vigorous and just system of taxation," not because we like taxes, but because, as Oliver Wendell Holmes said, taxes are the price we pay for a civilized (...) society. We have been having a tax debate for more than a century, but what is new about today's debate is that tour leaders want to shift the tax burden from unearned income straight on to the backs of working people. This radical notion turns on its head the very values that built America — rewarding hard work. My radical notion is that it is time to abolish the work penalty by abolishing the tax code of special privileges for wealth. In this talk I set forth a set of ideas to do just that, and further I show how we can use our tax code to encourage asset building and reduce poverty. (shrink)

Through bisociation, the use of one discipline to illuminate another, some of them can be resolved. To put it simply, the translation should fit the plate. Just as Homer, the poet of the Achaians, wrote a description (...) of a Troy whose existence was proven by close textual readings and subsequent field work by Schliemann, so Apicius, the Roman artist of cuisine, left recipes whose language can be emended and whose tastes can be verified through practical experiment in the modern kitchen.The limits of a strictly philological approach to Apicius became apparent when, during my composition of The Roman Cookery of Apicius, the translation of a number of recipe titles was inconsistent with the technical information which followed. This was extraordinary because of Apicius' imperative, laconic style, whose formulae more resemble the ritualistic epithets of the annals of the Hittite kings than the informed, conversational prose of an Elizabeth David or an M. F. K. Fisher. In his text there is little question of subjectivity in the nomenclature, or puns or literary allusions to test the reader. Indeed, in all ten books of the Coquinaria and in the later and derivative Excerpts of Vinidarius only twice does Apicius emerge from anonymity, at 4.2.12 ("ad mensam nemo agnoscet quid manducet"), and at 1.9.1 (miraberis); and, in any case, I think these uncharacteristic asides are really the happy observations of a copyist. The third atypical remark which puzzles is a reference to a lost and presumably illustrated version of his book. The reference is tantalizing and colloquial, the words perhaps of an editor: "patellam aeneam qualem debes habere infra ostenditur" (4.2.14).The Coquinaria is not written in the colloquial Latin of Petronius' Satyricon, with which it is probably contemporary. His text is spare to the point of postmodern bleakness; there is nothing, except some of the actual ingredients, of the decadence of the Cena Trimalchionis. It is a collection of lists and brief instructions, often formulaic, never personal. It follows, then, that what remains is the essential manual, stripped of nuance and personality through centuries of use and transmission, rather [End Page 255] like the spare lists of foodstuffs written by Anthimus in his De Observatione Ciborum or in Gargilius' De Hortis. The words must literally convey their meanings to the careful cook. The temptation to be swayed by a perhaps unusual or delicious adjective must be resisted. These variations are caused by the mixing of classical and late Latin forms in a text much altered by the long history of its transcription. It would seem that we in the West are suffering from an increasing glut of rights. To the sixty-odd human rights that the Universal Declaration and its Covenants have long given us, must now be added the particular rights claims of an increasing number of ‘oppressed’ minorities, claims to compensation rights for just about every conceivable harm done and claims to ever more trivial things. This tendency is harmful insofar as it trivialises rights and devalues the coverage of rights. Human (...) rights are fundamental and ought to be protected from these tendencies. Using an analysis of the foundations of human rights, and their function in maintaining autonomy in particular, this article analyses the content of rights – what must be fulfilled in order for a right to be protected – as a means of demonstrating the possibility of reducing the volume of rights without reducing rights coverage and of creating a defensible hierarchy. The ethical value—and to some scholars, necessity—of providing trial patients with post-trial access (PTA) to an investigational drug has been subject to significant attention in the field of research ethics. Although no consensus has emerged, it seems clear that, in some trial contexts, various factors make PTA particularly appropriate. We outline the atypical aspects of psychedelic clinical trials that support the case for introducing the provision of PTA within research in this field, including the broader legal status of psychedelics, the (...) nature of the researcher-therapist/participant relationship, and the extended time-frame of the full therapeutic process. As is increasingly understood, the efficacy of psychedelic-assisted psychotherapy is driven as much by extrapharmacological elements and the cultural therapeutic container as by the drug itself. As such, we also advocate for a refocusing of attention from post-trial access to a broader concept encompassing other elements of post-trial care. We provide an overview of some of the potential post-trial care provisions that may be appropriate in psychedelic clinical trials. Although the World Medical Association’s Declaration of Helsinki calls on researchers, sponsors, and governments to make provisions for post-trial access, such provision may feel impracticable or out-of-reach within psychedelic trials that are already constrained by a high resource demand and significant bureaucratic burden. We show how conceiving of post-trial provision as an integral site of the research process, and an appropriate destination for research funding, will serve to develop the infrastructure necessary for the post-legalisation psychedelic medicine ecosystem. While nothing justifies atrocity, many perpetrators manifest cognitive impairments that profoundly degrade their capacity for moral judgment, and such impairments, we shall argue, preclude the attribution of moral responsibility.

There is a growing recognition, stemming from work with both vertebrates and invertebrates, that the capacity for neuronal regeneration is critically dependent on the local microenvironment. That environment is largely created by the non‐neuronal elements of the nervous system, the neuroglia. Therefore an understanding of how glial cells respond to injury is crucial to understanding neuronal regeneration. Here we examine the process of repair in a relatively simple nervous system, that of the insect, in which it is possible to define (...) precisely the cellular events of the repair process. This repair is rapid and well organised; it involves the recruitment of blood cells, the division of endogenous glial elements and, possibly, migration from pre‐existing glial pools in adjacent ganglia. There are clear parallels between the events of repair and those of normal glial development. It seems likely that the ability of the insect central nervous system to repair resides in the retention of developmental capacities throughout its life and that damage results in the activation of this potential.
